If I Was Arrest and Not Prosecuted, Can I Have My Record Expunged in Oklahoma?

If I was arrested but never prosecuted for a crime in Oklahoma, can I have that record expunged? Hi, I’m Oklahoma City Attorney Aaron Easton, and that’s the question we have before us today. And the answer to that question is, it’s possible.

So under Title 22, Section 18, the Oklahoma statutes deal with expungements, and there are several subsections in that chapter, and one of those, specifically Section 5, deals with the scenario in which an individual was arrested but not prosecuted. And so the key to that is, if the agency that would prosecute you has either A, officially declined to file charges against you for that crime, or B, the statute of limitations for that crime has run, then you’re entitled by statute to get that record expunged, the arrest record specifically.

So if you are in a situation where you have been arrested at some point in the past, the state has not filed charges, you may be in a position where you could get that expunged, but you’re going to want to speak to an attorney about the specifics of your case, both privately and confidentially, to see if you might qualify for that expungement.
